Terms of Service

Welcome to Scheduling Desk. Scheduling Desk is a product of Createchz MMC (“we,” “us,” or “our”), a company legally incorporated and operating under the laws of the Republic of Azerbaijan.

By accessing, registering for, or using our website, application, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Createchz MMC concerning your access to and use of Scheduling Desk. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Description of Service

Scheduling Desk is an online software-as-a-service (SaaS) platform that optimizes calendar coordination and client communication. The core functionalities of the Service include:

  • Synchronizing real-time availability with your connected Google Calendar to prevent scheduling conflicts.
  • Generating distinct public booking pages for multiple business personas or entities managed under a single account workspace.
  • Automating the dispatch of booking confirmations and 15-minute reminders to you and your clients via email and WhatsApp.

3. Account Registration and Security

To utilize the Service, you must register for an account by providing accurate, current, and complete information.

  • You are entirely responsible for safeguarding your account access credentials.
  • You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
  • Createchz MMC cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. Third-Party Integrations and Customer Data

Our Service natively integrates with external platforms to function effectively. By using Scheduling Desk, you acknowledge and agree to the following:

  • Google Integration: The Service requires OAuth authorization to access your Google Calendar data. Our access, use, and storage of your Google user data are strictly bounded by our Privacy Policy and the Google API Services User Data Policy.
  • WhatsApp Integration: Automated notifications are dispatched using WhatsApp infrastructure. You are solely responsible for ensuring that you have obtained explicit consent from your clients to contact them via WhatsApp prior to scheduling any automated messages.
  • Compliance:Your use of these integrations must comply with Google’s Terms of Service and Meta’s WhatsApp Business Terms of Service.

5. Acceptable Use and Prohibited Conduct

You agree to use Scheduling Desk only for lawful business or personal coordination purposes. You are strictly prohibited from:

  • Utilizing the automated notification engine to send unsolicited marketing, spam, or bulk messages.
  • Harassing, abusing, or sending threatening content to any client or contact through our messaging channels.
  • Attempting to reverse-engineer, decompile, disrupt, or compromise the underlying code, security, or server infrastructure of the Service.
  • Violating any applicable local, national, or international laws or regulations.

6. Subscription Fees and Billing

  • Current Tier: The Service may offer a baseline free tier with specified usage limitations.
  • Modifications: We reserve the right to introduce paid subscription packages, feature restrictions, or adjust pricing structures in the future.
  • Notice: Any implementation of subscription fees or premium billing structures will be communicated clearly to users prior to enforcement, giving you the choice to upgrade or discontinue use.

7. Intellectual Property Rights

Scheduling Desk, including its unified layout, custom source code, brand assets, logos, and features, is the exclusive intellectual property of Createchz MMC. You are granted a limited, revocable, non-exclusive, non-transferable license to access the interface solely to manage your schedules. You may not copy, replicate, or exploit any portion of our design or functionality without explicit written consent from us.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether explicit or implied.

  • Createchz MMC does not guarantee that the Service will be entirely uninterrupted, error-free, or securely immune from unexpected technical failures.
  • Because message dispatch relies on external networks and upstream API connectivity, we are not responsible for delayed notifications or transient socket drops caused by network service degradation outside of our direct server execution.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Createchz MMC, its directors, employees, or tech partners shall not be held liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, data, opportunities, business goodwill, or other intangible losses resulting from your reliance on the Service or calendar synchronization anomalies.

10. Indemnification

You agree to defend, indemnify, and hold harmless Createchz MMC and its subsidiaries from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party rights, including privacy or communication regulations.

11. Termination of Service

We reserve the right to suspend or terminate your account and restrict access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests. You may terminate your account at any time by ceasing use of the Service or requesting data deletion.

12. Governing Law and Jurisdiction

These Terms and your relationship with Scheduling Desk shall be governed by, and construed in accordance with, the substantive laws of the Republic of Azerbaijan. Any legal action, suit, or dispute arising under or in connection with these Terms shall be brought exclusively before the courts located in Baku, Azerbaijan.
